Terms of Service

1. These Terms
These Terms govern your use of ImgVid at imgvid.app (the "Service"). By creating an account or using the Service, you agree to them.
The Privacy Policy, the Cookie Policy, and the Refund Policy also form part of your agreement with us. Each covers its own subject: personal information, cookies, and refunds. Everything else is covered here.
2. Eligibility and accounts
(a) You must be at least 13 years old, and old enough under the law where you live to enter into a binding contract. If you are under 18, you may use the Service only with the consent and supervision of a parent or guardian.
(b) You must sign up with an email address you control and verify it before using features that require an account. You can also sign in with a supported third-party account.
(c) Your account is for you alone. You may not transfer, sell, rent, or share it, and you are responsible for keeping your password safe. We treat anything done through your account as done by you.
(d) If you use the Service for an organization, you confirm that you are authorized to accept these Terms on its behalf, and the organization is bound by them.
(e) You may not create multiple accounts to collect sign-up credits, promotional credits, or similar benefits.
3. Credits and plans
(a) The Service runs on credits. Credits are deducted the moment you submit a generation request. If a generation fails because of a problem on our side or at the model provider, we return those credits to your balance automatically.
(b) Credits are a prepaid allowance for using the Service. They are not money, they have no cash value, and they cannot be transferred, sold, withdrawn, or moved between accounts.
(c) How long credits stay valid, and what each plan includes, is set out on the purchase page. We may change plans, benefits, and prices, but not for benefits you have already bought that are still valid.
(d) Payments, refunds, and subscription cancellation are covered by the Refund Policy.
(e) If your subscription ends or you do not renew, your account moves to the free plan. Credits already granted stay usable until they expire.
4. Your content
(a) "Your content" means the images, video, and audio you upload, together with the prompts and settings you enter.
(b) You must hold the rights to everything you upload. By providing content, you confirm that you own it or have permission from whoever does, and that using it infringes nobody's intellectual property, likeness, reputation, privacy, or other rights.
(c) To run the Service we need permission to handle your content, so you give us a license to store, transmit, and process it, and to send it to the model providers that carry out the generation you asked for. We use that license only to provide the Service to you. It ends when you delete the content or your account, except where these Terms or the law require otherwise.
(d) We do not use your content to train our own models. Where your content is stored, how long we keep it, and how it is deleted are covered in the Privacy Policy.
(e) File formats and size limits are shown in the product.
5. What you generate
(a) As long as you follow these Terms, what you generate is yours to use, including commercially. We claim no ownership of it.
(b) AI models are not deterministic. The same or a similar prompt can produce similar results for different people, and we do not promise that a result is unique, accurate, or fit for what you have in mind.
(c) Whether AI output can be copyrighted, and how far that protection reaches, depends on the law where you live. Weigh that risk yourself before you publish, advertise with, or distribute a result.
(d) Paragraph (a) does not apply to anything generated in breach of these Terms.
6. Prohibited content and conduct
You may not use the Service to generate, upload, store, or share:
(a) anything that breaks the law;
(b) pornography, adult content, or sexually suggestive material. This applies no matter who is depicted: real or fictional, adult or otherwise, photographic or AI-generated, and whether or not the person depicted agreed;
(c) sexualized depictions of minors, or child sexual abuse material of any kind. See Section 7;
(d) deceptive material built from a real person's face, voice, or identity, including impersonation and fabricated words or actions. See Section 8;
(e) content that incites hatred, discrimination, violence, terrorism, or self-harm;
(f) gore, shock content, or gratuitous violence;
(g) harassment, threats, or defamation;
(h) content that infringes someone else's intellectual property, likeness, reputation, privacy, or other rights;
(i) fraud, phishing, false advertising, or other deception;
(j) malware, viruses, or other destructive code.
You also may not:
(k) work around, or try to work around, credit deductions, rate limits, moderation, account permissions, or any other control;
(l) reverse engineer, decompile, or scrape the Service, or send automated requests beyond normal use;
(m) resell or sublicense the Service, or use it to run a competing service, without our written consent;
(n) disrupt the Service, or put its security or that of other users at risk.
7. Minors and child safety
(a) Section 2(a) sets the minimum age for the Service, and anyone under 18 needs a guardian's consent and supervision. You may not create a character, avatar, or likeness of a minor.
(b) We have zero tolerance for child sexual exploitation and abuse (CSAE). The following are prohibited outright, whether the depiction is fictional, animated, photorealistic, or AI-generated:
- child sexual abuse material (CSAM), and any sexualized depiction of a minor;
- uploading a minor's image, video, or voice in order to generate sexualized or sexually suggestive material;
- using the Service to groom, coerce, or sexually extort a minor, or to distribute such material;
- material relating to the sexual exploitation or trafficking of minors;
- rephrasing prompts, splitting requests, or otherwise evading moderation to produce any of the above.
(c) We screen prompts automatically and block requests that violate this Section. Where necessary, generations and their output are reviewed by staff assigned specifically to this work.
(d) If we confirm a violation, we terminate the account permanently and immediately, and we do not refund the credits left in it. We preserve the relevant records as the law requires so that investigators can use them, and we report to the authorities. Where it applies, we also report to the National Center for Missing & Exploited Children (NCMEC), flagging whether the material was AI-generated.
(e) Anyone can report content or behavior on the Service that breaches this Section to abuse@imgvid.app. We prioritize these reports.
8. Non-consensual intimate imagery, deepfakes, and likeness rights
(a) You may not use someone's face, body, or voice to create, store, or share intimate imagery, sexualized material, or anything else that person has not agreed to make public. No purpose justifies it.
(b) You may not use a recognizable person's face or voice, without their permission, to make something that could lead others to believe they said or did something they did not. Satire, commentary, and art are no exception where the result is convincing enough to mislead.
(c) You may not use the Service, or anything made with it, for revenge porn, sextortion, harassment, defamation, or impersonation.
(d) When you upload material containing someone else's face or voice, you confirm that you have their express permission to use it this way. That holds for public figures too. You are responsible for that permission being real, and Section 4(b) applies.
(e) If your face or voice has been used in content that breaches this Section, you or your legal representative can ask us to take it down at abuse@imgvid.app. Include the links and enough information for us to verify the request. Once we have, we remove the content and act on the account behind it.
9. Moderation and enforcement
(a) We screen prompts automatically before a generation runs and block those that violate these Terms. Screening is automated: it is not a judgment that content is lawful, and it does not shift responsibility for your content away from you.
(b) We may review your content and your results where we need to. If we find a breach of these Terms, we may remove content, restrict features, and suspend or terminate your account, and we report to the authorities where the law requires it.
(c) If we suspend or terminate an account for breaching these Terms, we do not refund the credits left in it.
10. Third-party models and services
(a) The Service gives you access to AI models from several providers, reached through third parties. Their names and trademarks belong to them. We are not affiliated with, sponsored by, or endorsed by any of them.
(b) Which models are available, and their versions, settings, output quality, and price, can change, pause, or disappear when the providers behind them change. We make reasonable efforts to keep what the product says in line with what you can actually use, but we do not guarantee that any particular model stays available.
(c) We also rely on third parties for hosting, storage, payments, email, and analytics. Your use of those services is governed by their own terms.
11. Availability and changes
(a) We may interrupt or limit the Service for maintenance, upgrades, provider outages, or events beyond our control. We give notice in advance where we can.
(b) We may change, add, or discontinue features. If we discontinue a core feature that paid benefits depend on, we handle the money side under the Refund Policy.
12. Suspension and termination
(a) We may suspend or terminate your account if you breach these Terms, put the Service or other users at risk, fail to pay, or use the Service in a way that could expose us to liability.
(b) You can stop using the Service whenever you like, and you can ask us to delete your account as described in the Privacy Policy.
(c) Sections meant to outlast the account do so, including Section 4(c), Section 5, and Sections 13 to 17.
13. Our intellectual property
The software, interfaces, design, documentation, trademarks, and related material behind the Service belong to us or to our licensors. Except as these Terms allow, you may not copy, modify, distribute, sell, or rent any part of it.
14. Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free, or completely secure, or that a result will meet your needs. Check what you generate before you use it.
15. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.
Our total liability under these Terms and for the Service will not exceed what you actually paid us in the twelve months before the event behind the claim.
Nothing here excludes liability that cannot be excluded by law.
16. Indemnification
If someone brings a claim against us because you broke these Terms or the law, or because of your content or what you generated, you will cover the reasonable losses, liabilities, and costs we incur, including reasonable legal fees.
17. Governing law and disputes
These Terms, and any dispute arising from them, are governed by the law of the jurisdiction in which we are registered, without regard to its conflict-of-law rules.
If a dispute arises, both sides will first try to resolve it in good faith. Failing that, it goes to the courts of the jurisdiction in which we are registered. None of this affects mandatory rights you have where you live, including the right to bring a claim in your local courts.
18. Changes to these Terms
We may update these Terms. If a change is material, we update the effective date at the top of this page and, where it matters, tell you by email or in the product. Using the Service after a change takes effect means you accept the updated Terms. If you do not accept it, stop using the Service; you can also ask us to delete your account.
